- North Dakota Department of Health is responsible for controlling pollution of surface waters, groundwaters and the air of the state.
- The department’s approval is required for concentrated feeding operations. Operators must submit site plans with setback distances and topographical information. Approval is granted if the department determines the operation will not pollute state waters. Letters of Approval may also specify measures to be taken for operations likely to cause pollution. Approvals are valid as long as the facility is not changed.
- Operations with livestock housing must store livestock manure for at least 180 days to avoid application on frozen ground. Storage structures must not overflow. Any runoff from confined areas or from solid manure storage must be contained on the property and prevented from reaching any natural drainage.
- Land application is recommended as the best way to keep manure out of the waters of the state, but volumes, application rates or nutrient levels are not regulated.
